Terms of Service

These terms govern your access to the ForestRace trail route platform and the services offered by Kunming Forestrace Network Technology Co., Ltd. Please read them fully, because using the platform means you accept this agreement.

1. Acceptance of Terms

By accessing or using the ForestRace platform, you confirm that you have read, understood and agreed to these terms. If you do not agree to any part of this agreement, you should stop using the platform and avoid creating an account.

These terms are entered into between you and Kunming Forestrace Network Technology Co., Ltd., a company registered at Rm 1714, Building 2, Yaolong Building, No. 265 Guangfu Road, Xishan District, Kunming - 650000, China (CN). References to we, us, our and the company in these terms mean that entity.

Use of the platform is voluntary and at your own risk. Some features require an account and your compliance with this agreement remains a condition of continued access.

2. Description of the Service

The ForestRace platform provides tools for trail and outdoor running events. It allows organizers to map routes, publish courses, manage registrations, coordinate volunteers and publish results. It also provides live tracking and checkpoint timing for participants during a race.

The service is designed as a planning and communication layer for events. It is intended to assist organizers and runners, but it does not replace responsible race management, official medical support or local safety procedures.

We may add, change or remove features over time as described in a later section. The exact feature set available to you depends on your account type and the region in which a race is held.

3. Accounts and Eligibility

To use certain features you must register an account. You must provide accurate and complete details when you sign up and you must keep that information current throughout the life of your account.

You must be old enough to form a binding agreement under the law that applies to you. If you are creating an account on behalf of a company, club or event, you confirm that you have authority to bind that organization.

You are responsible for keeping your login credentials secure. You agree to notify us promptly if you suspect unauthorized use of your account so that we can help protect your data.

Only one account is normally allowed per individual across the platform. Duplicate accounts may be merged or closed if we detect abuse or confusion.

4. Permitted and Prohibited Use

You may use the platform for lawful purposes related to trail race planning, participation and community running. You agree not to use the service to send unsolicited messages, distribute malware or attempt to access data that does not belong to you.

You must not attempt to circumvent security controls, overload our servers or interfere with the availability of the service for other users. Automated scraping of public pages is permitted only where it does not disrupt normal operation.

You agree not to upload content that is defamatory, fraudulent, obscene or otherwise unlawful. We may remove content that violates these terms or that we reasonably consider harmful to the community.

Where a feature sets a rate limit or a storage limit, you must stay within that limit. Continued abuse may result in suspension as described in the termination section.

5. User Content

Content that you post, such as race descriptions, route notes, photos and comments, remains yours. We do not claim ownership of the content you provide.

By posting content to a shareable area of the platform, you grant us a limited license to host, display and distribute that content so that we can operate and promote the service. This license ends when you delete the content, except where copies are legally required for archival or support purposes.

You are responsible for the content you publish and for ensuring that you have the rights needed to publish it. Publishing another persons copyrighted material without permission is your responsibility, not ours.

We may use aggregate, anonymized race statistics to improve the service. This does not expose your private data and is separate from the rights described in our privacy policy.

6. Intellectual Property

The ForestRace name, logo, graphic elements and the overall look and feel of the platform are the property of the company or its licensors. You may not reproduce them without written permission.

The software, analytics tools, race timing logic and design system that make up the service are protected as intellectual property. You may not reverse engineer, decompile or copy core components of the platform.

Route maps and elevation data shown in the service come from licensed providers. The display of such data is limited to use within the platform, and you agree not to republish maps in a way that violates those provider terms.

7. Fees and Payment

Parts of the service are free and parts may be offered under a paid plan. Plan pricing and feature entitlements are shown before you subscribe or purchase.

Payment is processed by a third-party payment provider. By purchasing, you authorize that provider to charge the method you select and you agree to the provider terms of service in force at the time.

Fees collected for race registrations on behalf of an organizer are held and settled according to the organizers chosen plan. Refund policies for a specific race are set by the race director and are clearly stated on the race registration page.

Prices may change from time to time. Any change to a recurring plan price will be communicated in advance, and you may cancel before the change takes effect.

8. Race Conduct and Safety

We provide tools to help organize and time a race, but safety is the responsibility of the race organizer and each individual participant. You must obey all applicable local rules and follow the instructions of race marshals and aid station staff.

Each runner is responsible for their own fitness, equipment and route awareness. The platform does not make an individual race safe; it simply provides mapping, tracking and registration support.

Race organizers agree to plan their event with due care, including suitable checkpoints, staffed aid stations and a plan for adverse weather. The company is not liable for decisions made by an organizer in the course of running an event.

Where a race includes open terrain, participants must respect the natural environment and the rights of landowners. We encourage every event to follow a leave no trace approach.

9. Live Tracking and Location

Live tracking is an optional feature that becomes active when a participant chooses to share location for a race. Consent to sharing applies only for the duration and scope of that event unless you choose otherwise.

Live position data is shown to others only according to rules set by the race organizer. By enabling live tracking, you understand that checkpoints, officials and authorized crew members may see your position.

We do not guarantee that live tracking will work without interruption. Network gaps, device battery and terrain can all delay location updates, and such delays are not a basis for a dispute against the company.

Final split and finish times are considered official results once published. Provisional splits during the event may be corrected before those results are finalized.

10. Availability and Changes

We aim to keep the platform available at all times, but we do not guarantee uninterrupted access. Maintenance, network issues and factors beyond our control may cause temporary downtime.

We may update the platform frequently. Changes may add features, change how some tools behave or retire features that are no longer supported. We will give reasonable notice of material changes where practicable.

A change to the service does not form a new contract on its own; you agree to these terms as updated under the section on changes below. Continued use after an update constitutes acceptance of the revised terms.

Where a feature relied on for a live event changes, we aim to announce it well before the affected race date so that organizers can adapt. Planned maintenance is usually scheduled outside peak event times. In an emergency, we will communicate an outage on the platform as soon as we are able, and we will work to restore service without delay.

11. Privacy

Our handling of personal data is set out in a separate document, the privacy policy. That policy is incorporated into these terms by reference and forms part of your agreement with us.

You consent to the collection and use of personal data as described in the privacy policy. You may exercise the rights described there, including access, correction and deletion.

If a conflict arises between these terms and the privacy policy about how personal data is handled, the privacy policy takes precedence for that specific matter.

By organizing a race through the platform, you are responsible for the lawful collection of the personal data of your participants. You agree to provide your own notice to those participants, to give them the rights they are due and to send us only data you are entitled to share. Where a participant asks you about the data held, you will cooperate with us to answer that request.

12. Termination and Suspension

You may stop using the platform at any time and delete your account from the account settings. Some historical records, such as published race results, may be kept in line with the retention rules in our privacy policy.

We may suspend or close an account if we reasonably believe it violates these terms, breaches the law or puts the platform or its users at risk. Where feasible, we will advise you before closing an account.

Upon termination, your right to use the platform ends. Sections of these terms that by their nature should survive, such as intellectual property, liability and governing law, will continue to apply.

Obligations that arose before termination remain effective, including payment for services already delivered or fees already payable.

13. Disclaimer and Liability

The platform is provided on an as is and as available basis. We make no warranties that the service will meet your needs, be error free, secure or fit for a particular purpose beyond those expressly described.

The company, its officers, staff and service partners will not be liable for indirect, incidental, special or consequential damages arising from your use of the platform, even if we have been advised of the possibility.

Our total liability for any claim related to the platform is limited to the amount you paid us for the relevant service in the twelve months before the claim arose, or one hundred US dollars if you paid nothing.

Nothing in these terms limits liability for fraud, willful misconduct, or harm that cannot be excluded under applicable law.

14. Indemnification

You agree to hold harmless and indemnify Kunming Forestrace Network Technology Co., Ltd. and its team members against claims, losses and reasonable costs that arise from your breach of these terms or from your use of the platform.

This obligation also covers content you publish and disputes you cause with other users, such as an organizer or a fellow runner. We will give you notice of any claim where we are able to do so.

Reasonable costs include legal fees and third-party expenses that relate directly to a covered claim. Where we can cooperate to reduce a claim, we will do so, but you remain responsible for the conduct that gave rise to it. If we partially caused a claim through our own fault, our rights under this section are limited to a fair share of the loss.

This section applies to the fullest extent permitted by law and remains in effect after your account is closed.

15. Governing Law and Disputes

These terms are governed by the laws of the region where the operating entity is registered, without regard to conflict of law rules.

We will first attempt to resolve any disagreement through good faith negotiation or mediation before formal proceedings are started. We welcome early communication about any concern you have.

Where a dispute cannot be resolved informally, it will be submitted to the competent courts that have jurisdiction over the operating entity, subject to any mandatory consumer protections that apply to you.

If any clause in these terms is found to be unenforceable, the remainder stays in force and the unenforceable part is read as narrowly as the law allows.

16. Changes to These Terms

We may revise these terms from time to time. When a revision is material, we will notify you through the platform or by email before the change takes effect.

If you do not wish to accept a revised set of terms, you may stop using the platform before the effective date. Continued use after the effective date means you accept the revised terms.

Archived copies of previous versions of these terms are available on request, so that you can review how the agreement has evolved.

We will keep the effective date of each revision clear so that you always know which version governs your use. A review request that arrives before a new version takes effect will be handled under the previous version. Changes that only affect clarity or internal wording may take effect without a separate notice.

We aim to respond to all genuine enquiries within three working days. Urgent matters relating to a race taking place within the current week should mention the event date and the need for a fast reply, and we will prioritize accordingly. Substantive questions about your account or a race are best sent by email so that the whole thread is kept together for review.

Official notices should come through the contact channels above and will be treated as delivered when a reply is received or when a reasonable confirmation is given.
